This website is operated by Archaneon Supplements LLC (“Archaneon,” “we,” “us,” or “our”). Archaneon offers this website, including all information, tools, and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here (collectively, the “Service”).
By visiting our site and/or purchasing something from us, you engage in our Service and agree to be bound by these Terms of Service (“Terms”), including any additional terms and policies referenced herein and/or available by hyperlink, including our Shipping, Returns & Subscription Policy and Privacy Policy. These Terms apply to all users of the site, including without limitation browsers, customers, merchants, vendors, and/or contributors of content.
If you do not agree to all the terms and conditions of this agreement, you may not access the website or use any Services.
Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

Eligibility; Online Store Terms
By agreeing to these Terms, you represent that you are at least the age of majority in your state or province of residence (or you are the age of majority and have consented to allow any minor dependents to use this site under your supervision).
You may not use our products or Services for any illegal or unauthorized purpose, nor may you violate any laws in your jurisdiction (including but not limited to copyright laws). You must not transmit any viruses, worms, or any code of a destructive nature.
A breach or violation of any of these Terms may result in immediate termination of your access to the Services.

Archaneon Supplements are dietary supplements and are not medicines. Statements made on this site, including claims about specific products, have not been evaluated by the United States Food and Drug Administration (FDA). Our products are not intended to diagnose, treat, cure, or prevent any disease.
You are responsible for reading all product labels, ingredient lists, warnings, and directions before use. You should consult a qualified healthcare professional before using any supplement, especially if you are pregnant or nursing, have a medical condition, have a history of sensitivity to stimulants, are under 18, or are taking prescription or OTC medication.
Individual results vary. To the fullest extent permitted by law, Archaneon is not responsible for harm caused by misuse of products, failure to follow label directions, or use contrary to warnings or contraindications.

General Conditions; Right to Refuse Service
We reserve the right to refuse service to anyone for any reason at any time, including (without limitation) suspected fraud, abuse, chargeback abuse, reseller activity, harassment of staff, or violation of these Terms.
You understand that your content (not including payment information) may be transferred unencrypted and involve transmissions over various networks and changes to conform to technical requirements. Payment information is always encrypted during transfer over networks.
You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service or access to the Service without our express written permission.

Products; Availability; No Guarantees
Certain products may be available exclusively online and may have limited quantities.
We have made every effort to display product images and colors as accurately as possible; however, we cannot guarantee your device’s display will be accurate.
We reserve the right, but are not obligated, to limit the sales of our products to any person, household, geographic region, or jurisdiction, and to limit quantities of any products, in our sole discretion.
We do not warrant that the quality of any products or services will meet your expectations or that any errors in the Service will be corrected.

Orders; Billing; Account Information
We reserve the right to refuse or cancel any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order, including orders placed under the same customer account, payment method, and/or billing or shipping address.
In the event we change or cancel an order, we may attempt to notify you via the email, billing address, or phone number provided at checkout.
You agree to provide current, complete, and accurate purchase and account information and to promptly update it so we can complete transactions and contact you as needed.
Returns, refunds, and cancellations are governed by our Shipping, Returns & Subscription Policy.

Subscriptions & Recurring Billing
If you enroll in a subscription (“Subscribe & Save” or recurring delivery), you authorize Archaneon to charge your payment method for the initial and recurring subscription orders at the then-current subscription rate until you cancel.
Cancellation
You may cancel your subscription at any time through your Customer Portal or by emailing support@archaneonsupps.com. There are no cancellation fees, penalties, or minimum commitment periods.
24-Hour Fulfillment Lock
To prevent fulfillment of an upcoming subscription order, cancellation requests must be submitted at least 24 hours before the scheduled billing date. If a cancellation request is submitted less than 24 hours before the billing date, the order may have already entered automated fulfillment and cannot be stopped. In such cases, the order will ship and may only be returned if unopened and in accordance with our Shipping, Returns & Subscription Policy.

Shipping; SavedBy Package Protection
Shipping timelines and risk allocations are governed by our Shipping, Returns & Subscription Policy.
SavedBy Package Protection is offered at checkout. If you opt out, you acknowledge and agree that Archaneon is not liable for loss, theft, or damage once the shipment leaves our facility, to the fullest extent permitted by law, and any resolution must be pursued through the carrier where applicable.

International Orders
International customers act as the Importer of Record and are responsible for applicable duties, taxes, customs fees, and compliance with local regulations.
Any restrictions on international refunds/returns are governed by our Shipping, Returns & Subscription Policy.

Optional Tools
We may provide access to third-party tools which we do not monitor and over which we have no control. You acknowledge and agree that we provide access to such tools “as is” and “as available” without warranties, representations, or conditions of any kind. We shall have no liability arising from or relating to your use of optional third-party tools.

Third-party links may direct you to websites not affiliated with us. We are not responsible for examining or evaluating the content or accuracy and we do not warrant and will not have any liability for third-party materials or websites.

User Content; Reviews; Feedback
If you send us creative ideas, suggestions, proposals, plans, reviews, photos, videos, testimonials, or other materials (“Submissions”), you agree that we may use, edit, copy, publish, distribute, translate, and otherwise exploit such Submissions in any medium for any lawful purpose, including marketing, without restriction or compensation, unless prohibited by law.
You represent and warrant that you own or control all rights to your Submissions and that our use will not violate any third party’s rights.
We may remove content that we determine in our sole discretion violates these Terms or applicable law.

Prohibited Uses
You are prohibited from using the site or its content for any unlawful purpose; to violate any laws; to infringe our intellectual property or the intellectual property rights of others; to harass, abuse, defame, threaten, or discriminate; to submit false or misleading information; to transmit malware; to scrape, crawl, or harvest data without authorization; to spam or phish; or to interfere with the security features of the Service.
We reserve the right to terminate your use of the Service for violating any prohibited uses.

Intellectual Property

Errors, Inaccuracies & Omissions
We reserve the right to correct any errors, inaccuracies, or omissions and to change or update information or cancel orders if any information is inaccurate at any time without prior notice (including after you submit your order). We undertake no obligation to update information except as required by law.

Disclaimer of Warranties
The Service and all products and services delivered to you through the Service are provided “as is” and “as available,” without any representation, warranties, or conditions of any kind, either express or implied, including implied warranties of merchantability, fitness for a particular purpose, durability, title, and non-infringement, except where such disclaimers are prohibited by law.

Limitation of Liability
To the fullest extent permitted by applicable law, in no case shall Archaneon, our directors, officers, employees, affiliates, agents, contractors, suppliers, service providers, or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability, or otherwise, arising from your use of the Service or any products procured using the Service, even if advised of the possibility of such damages.
In jurisdictions that do not allow the exclusion or limitation of liability for consequential or incidental damages, our liability shall be limited to the maximum extent permitted by law.
To the fullest extent permitted by law, Archaneon’s total liability for any claim arising out of or relating to the Service or products shall not exceed the amount paid by you to Archaneon for the product(s) giving rise to the claim.

Indemnification
You agree to indemnify, defend, and hold harmless Archaneon and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns, and employees from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your breach of these Terms, your violation of any law, or your violation of any third-party rights.

Dispute Resolution; Small Claims Carve-Out; Binding Arbitration; Class Action Waiver
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
Small Claims Carve-Out
Either you or Archaneon may bring an individual action in small claims court in Denver County, Colorado (or, if you live outside Colorado, the small claims court in your county of residence), provided the claim remains in small claims court and is brought only on an individual basis.
Agreement to Arbitrate
Except for the small claims carve-out above and intellectual property or unauthorized access disputes seeking injunctive or equitable relief, you and Archaneon agree that any dispute, claim, or controversy arising out of or relating to these Terms, your purchase or use of products, the Service, or the breach, termination, enforcement, interpretation, or validity thereof (each, a “Dispute”) will be resolved by binding individual arbitration rather than in court.
Arbitration Rules and Forum
The arbitration will be administered by the American Arbitration Association (“AAA”) in accordance with its Consumer Arbitration Rules then in effect. The arbitration will take place in Denver County, Colorado, unless you and Archaneon agree otherwise, or unless required by applicable law.
Authority of Arbitrator
The arbitrator shall have exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability, or formation of this arbitration agreement, including any claim that all or any part of this arbitration agreement is void or voidable.
Class Action Waiver
YOU AND ARCHANEON AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, REPRESENTATIVE, OR PRIVATE ATTORNEY GENERAL PROCEEDING. The arbitrator may not consolidate more than one person’s claims and may not otherwise preside over any form of representative or class proceeding.
Jury Trial Waiver
If for any reason a Dispute proceeds in court rather than arbitration, you and Archaneon waive any right to a jury trial.
This arbitration provision shall survive termination of these Terms.

SMS/MMS Mobile Message Marketing Program Terms
Archaneon offers a mobile messaging program (the “Program”). By opting in to or participating in the Program, you agree to these Mobile Messaging Terms and our Privacy Policy (together, the “SMS Agreement”). This SMS Agreement applies only to the Program and does not modify other Terms.
Opt-In
By opting in, you agree to receive recurring automated marketing and/or transactional SMS/MMS messages at the phone number you provided. Consent is not a condition of purchase. Message frequency varies. Message and data rates may apply.
Opt-Out
To opt out at any time, reply STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to any message. You may receive a final confirmation message.
Support
For support, reply HELP to any message or email support@archaneonsupps.com. Email is not an acceptable method of opting out; opt out by replying STOP (or similar keywords above).
Number Changes; Duty to Notify
If you change, surrender, or transfer the phone number you used to opt into the Program, you agree to opt out prior to changing your number. To the fullest extent permitted by law, you agree to indemnify and hold harmless Archaneon and any service providers assisting with message delivery from claims arising from your failure to do so, including claims under the Telephone Consumer Protection Act (TCPA) or similar laws.
Program Availability / Carrier Disclaimer
The Program is offered on an “as-is” basis and may not be available in all areas at all times. Delivery is subject to your carrier’s network and is outside our control. We are not liable for delayed or undelivered messages.
Age Restriction
You may not participate in the Program if you are under 13 years of age. If you are between 13 and 18, you must have a parent or legal guardian’s permission.

Termination
These Terms are effective unless and until terminated by either you or us. We may terminate or suspend your access to the Service at any time if, in our sole judgment, you violate these Terms. Obligations and liabilities incurred prior to termination shall survive termination.

Entire Agreement
These Terms and any policies or operating rules posted by us on this site constitute the entire agreement between you and us and govern your use of the Service, superseding any prior agreements and communications.

Severability
If any provision of these Terms is determined to be unlawful, void, or unenforceable, such provision shall be enforceable to the fullest extent permitted by law, and the unenforceable portion shall be severed. The remaining provisions remain in full force and effect.

Governing Law
These Terms and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to conflict of laws principles.
